LTB co-op evictions – report on the first 10 orders

Since June 1, 2014, the Landlord and Tenant Board has handled co‑op evictions in Ontario.  So, I’m sure you’ll all wondering, how has it gone?  We were wondering too, so we reviewed the first ten orders that have been issued by the LTB and published on CanLII, Canada’s free on‑line database of legal decisions.

Expiring co-op housing operating agreements: An opportunity for housing innovation

Canada Mortgage and Housing Corporation’s (CMHC) operating agreements with non‑profit housing co‑operatives and rental housing providers have begun to expire across Canada at a rapid rate. These agreements with their related mortgages, entered into under various federal programs between 1970 and 1994, supply housing providers with between 25 and 40 years of annual subsidy money to provide reduced monthly charges to a specified percentage of tenants and members who qualify for support. With the conclusion of these agreements and their related mortgages, housing providers will cease making mortgage payments, but at the same time, they will no longer receive housing subsidy payments — payments that subsidize some 200,000 households in Canada comprising half a million people. While not all subsidized housing providers in Canada get their subsidies through CMHC operating agreements, the potential loss is a big blow to the sector. This, on top of an already serious affordable housing shortage, is cause for concern.

Co-op Evictions: New LTB process begins June 1

As many of you know, today marks the last day to file an application in Superior Court to evict members from housing co‑operatives. Starting June 1st, co-op evictions will be handled by the Landlord and Tenant Board. This is the end of a long relationship we have had with many housing co‑operatives in the GTA and beyond helping them make difficult eviction decisions and then process those through the court system. It has been our pleasure to work with you on these.

Iler Campbell at Co-operative Housing Federation Canada AGM

Celia Chandler will be at the CHF Canada AGM in Ottawa on June 4th and 5th participating in the Co-operative Management Conference and Member Education Forum. With over 750 attendees, the AGM is the largest co-op housing event in Canada. We’re thrilled to be part of it this year. On Wednesday June 4th Celia will participate in a town hall titled “Responding to the changing needs of co-op members.” On Thursday June 5th she will lead a workshop titled “Learning to make your case at the Landlord and Tenant Board.”

Shelina Ali will be leading a workshop on minute taking, Saturday April 26, at the Co-operative Housing Federation of Toronto’s 2014 Spring Member Education Event. Her workshop, entitled Minutes Matter, aims to take the mystery out of taking minutes for housing co-ops.

Iler Campbell at Central Ontario Co-operative Housing Federation Spring Education Conference

Celia Chandler and Lauren Blumas will be presenting at the Central Ontario Co-operative Housing Federation Spring Education Conference this Saturday in Cambridge. Their workshop will explore human rights issues and issues that people claim are human rights issues in co-op housing. They’ll address how to determine which issues are really human rights issues, what to pay attention to in by-laws and policies concerning human rights, how to respond when questioned and what to do if you receive a human rights application.
