In support of the Government of Canada’s position, Dalhousie’s team will represent the intervener, the Canadian Institute of Petroleum Companies, arguing there is no common law recognition for the existence of a public right to a healthy global atmosphere.
WCEL says courts should recognize a common law public right to a healthy atmosphere, on the basis of the public’s right to air, the time immemorial reliance on the global atmosphere and on the basis that the global atmosphere is inherently public and incapable of ownership.
